Employee or Independent Contractor: Where to Draw the Line

Topic Description

How many times have you been approached by workers or prospective workers and been asked not to put them on the payroll? Recent developments in the courts make it essential to define and recognize the differences, and make the requisite deductions accordingly. Payroll professionals who fail to do so put themselves and their organizations at risk of liability and compliance penalties.

This informative session examines the necessity for payroll professionals to distinguish between independent contractors and employees, based on the speaker's recently published article, “Staff or Contractor: Where the Line is Drawn.”

This 90-minute session will include a 40-minute presentation, responses to pre-submitted questions and an open forum to ask your questions to our subject matter expert.

Participants are encouraged to submit their questions in advance to Steven Van Alstine prior to the session and can do so by emailing steven@payroll.ca before August 7, 2009.

About the Speaker

David A. Whitten, B.A., LL.B., is a founding partner of Whitten & Lublin LLP, a boutique employment law firm focused on delivering strategic resolution to workplace issues and challenges. The firm offers expert advice to both employers and employees in the non-unionized setting. It is experience on both sides of the table that enables the firm’s lawyers to deliver exceptional results for its clients.

David’s practice is devoted exclusively to providing employment law counsel. He has advised a variety of businesses and industries in both provincial and federal jurisdictions and public and private sectors on workplace safety and insurance issues, employment standards, human rights, hiring, terminations and common law obligations in Canada.

On the other side, he has successfully negotiated superior employment agreements and termination packages for his employee clients. Whether it be for an employer or employee, David always has a view to the bottom line and the optimal result for each client. Conscious of the impact of litigation, he is skilled in negotiated resolution and a tenacious and resourceful advocate before the courts and administrative tribunals when settlement cannot be achieved.

The session will be facilitated by Steven Van Alstine, Vice-President of Compliance Programs and Services for the CPA.
