Terminations: Payroll Obligations Under Common Law
CPA Web Seminar Series
PRESENTED DIRECT-TO-YOUR-DESKTOP by the Canadian Payroll Association
Archived Web Seminar
Topic Description
Do you know what a terminated employee is entitled to beyond what is called for legislatively? If not, you only know half the story. Participate in this web seminar to ensure your organization is in full compliance.
In the vast majority of cases, an employee’s entitlement upon termination goes far beyond what is prescribed by provincial employment standards legislation. Failing to address this additional “common law entitlement” can result in needless conflict and has the potential to significantly prolong severance negotiations.
Unless employees have executed an enforceable employment agreement with a severance provision, they are entitled to “reasonable notice” or pay in lieu of thereof based on a number of factors that are unique to each individual. Unlike terminated employees’ statutory entitlement, calculating their common law entitlement is more of an art than a science, and you need to master it.
This web seminar will explore what the statutes don't tell you and is directly relevant to all payroll professionals regardless of the jurisdiction in which they provide services. Topics include:
- Human rights considerations
- Calculating reasonable notice periods under the common law
- How to determine what compensation and benefits must be continued or included during a reasonable notice period
- Additional “damages”
- How to structure severance packages
- How to motivate terminated employees to find new employment
- The impact of re-employment and/or employment insurance benefits
- Retiring allowances
- Releases
